Win for Qualico after court rules against impact fee bylaw

Mark Newman represented the Qualico Group of Companies in recent litigation challenging the validity of the Impact Fee bylaw imposed on the granting of building permits for residential construction by the City of Winnipeg.

In a recently released decision the Manitoba Court of Queen's Bench determined that the legislation is not enforceable and ordered the repayment of all Impact Fees collected since the implementation of the Bylaw which is anticipated to be in excess of $30 million.
